I largely agree with you, Mark. Based on my five decades of practice before Federal Courts in multiple jurisdictions, I am confident that the courts will protect against unconstitutional or unlawful conduct by the Trump Administration. In fact, I expect multiple litigations, which I predict will be successful, if Trump invokes the Insurrection Act to use the military to round up undocumented immigrants since the only insurrection America has recently experienced was January 6. No doubt many fine law firms and lawyers already have their complaints, show cause orders and supporting papers prepared to get injunctive relief. That’s what I would be doing.

Mark, I know you're a lawyer. You've mentioned that before. But I don't understand whence you get much optimism. A majority of SCOTUS justices declared Roe settled law. Then overthrew it. Juan Merchan, if he hasn't already, is reportedly going to dismiss the Trump convictions, and the opportunity to sentence him. And Aileen Cannon, who is evidently not one bit put off by being overturned. It's true, as you say, that over 60 courts threw out Donnie and his incessant whining, blaming, and accusing, but nothing else came of it. Why would the SCOTUS decline to take on tenuous cases? They invented the idea of immunity for their golden boy. "Civil disorder will result if they sanction violations of laws and regulations?" Civil disorder resulted because no one sanctioned violations of laws and regulations.

Donnie's been brought to court lots of times. He's even had convictions. (Not to mention the two impeachments) But nothing happens. He complains about fines, like to pay Jean Carroll, but then gets his sycophants to give him the money.

You know much better than I do, but I wouldn't trust the Roberts court do anything legal and adaptive. They've already told us clearly that they refuse to be held even to ethical standards. I just don't see any evidence why any court should be trusted for anything. Yeah, OK, those 60+ courts did throw out his complaints, but he never stopped whining about it, taking up all the oxygen in the room, and bizarrely got himself re-elected with even more support than in '16 and '20.

"Usher the Democrats into power?" "Retribution" if they do? In '16, when Donnie gave the public every reason to suspect he was an idiot, an inveterate liar, and cared about nothing but himself, he got elected. Four years later, when he proved that he was an idiot, an inveterate liar, and cared about nothing but himself, he got more votes than he had before. After four more years of making a complete fool of himself, in every way possible, he got elected again, this time with the EC and the popular vote. I just don't see what stops this. SCOTUS? Not from what they've shown us.

There's already massive legal, political, and social upheaval. He loves it. He takes it to the bank.

Another impeachment? And likely to be convicted? By whom? We've lost both houses of Congress. Greene's back, Boebert's back, Cruz is back, Scott is back, Hawley is back. Maybe the midterm will flip the House. Maybe it'll flip the Senate. Maybe not. We're going in the wrong direction.

No, I'm sorry to say. It doesn't reassure. "Existential crisis," indeed.

Oh cmon Mark… be serious. Every single trial loss by Trump will be reversed by SCOTUS in a 6-3 decision. The Federal Judiciary in general, and SCOTUS in particular, are totally compromised and now function simply as extensions of the Republican Party.

If you think that I’m over reacting, let’s remember that Trump hasn’t had to spend a nanosecond in Federal Court defending himself from any of the myriad charges against him. The Federal Judiciary has been totally complicit with the DoJ in the “Delay, delay, delay… and hope that it all goes away” strategy to prosecuting Trump.

The courts are no longer interested in protecting our rights and liberties.
